Residents in Qatar can change their work organisation within 90 days from the date of expiry of their residency permits. The new decision was published in the Official Gazette, as posted by the Ministry of Justice on its Twitter account on 20 September 2020.
Under the new decision, employers must provide an additional contract for temporary workers (ayara) in addition to the worker’s primary job contract. This amendment is stated in the Minister of Interior’s Decision No. 51 of 2020, which modified some of the executive regulations of Law No. 21 of 2015, governing the entry, exit, and residency of expatriates.
The Official Gazette of the State of Qatar, numbered 15, featured the published decision. The Ministry of Justice announced the Gazette’s release on its Twitter account.
Article No. 1 of Minister of Interior Decision No. 51 of 2020 mandates the substitution of the wording in Article No. 65 and 67 of the executive regulation of Law No. 21 of 2015.
Following the amendment of Article No. 65, the work arrangement of the expatriate will be modified in compliance with the applicable regulations and guidelines.
The expatriate must follow the established procedures and inform the relevant department at the Ministry of Administrative Development, Labor, and Social Affairs of the changes made to their work arrangement.
As per the amended Article No. 67, if the residency permit of an expat is valid or within 90 days of its expiry (except in cases where the permit’s expiration was out of their control), the employer must submit an additional contract for temporary workers. This contract should be endorsed by the Ministry of Administrative Development, Labor, and Social Affairs and signed by both the employer and the expatriate worker in addition to the primary job contract.
Article 2 expresses that article 66 of the executive regulations of Law no. 21 of 2015 referred to be cancelled.
As per the Article 3 of the decision, all authorities concerned should execute this decision from the next day of the publication in the Official Gazette.
